The Independent Corrupt Practices and Other Related Offences Commission ICPC says it has formally opposed a fresh bail application filed by former Kaduna State governor, Nasir El-Rufai, in an ongoing case before the Kaduna State High Court.
At the resumed hearing on Tuesday, counsel to the defendant Ubong Akpang informed the court of a new bail request, noting that it relates to the defendant’s liberty and that all necessary legal processes had been completed.
However, ICPC counsel Ibrahim Mukhtar told the court he had only just been served with additional documents supporting the application and requested time to study the filings.
The presiding judge, Justice D.H. Khobo, subsequently adjourned the matter to May 13, 2026, for hearing.
The Commission recalled that the court had earlier refused to grant bail to El-Rufai after considering facts presented by the prosecution. These included concerns about possible flight risk due to the defendant’s influence, alleged obstruction of arrest at the Nnamdi Azikiwe International Airport, refusal to surrender travel documents and devices, and the likelihood of interference with witnesses and evidence.
According to the ICPC, the court affirmed that bail is discretionary and must align with the interest of justice. It also noted that the defendant did not challenge key allegations in the Commission’s counter-affidavit and dismissed health claims for lack of supporting evidence.
The court therefore ordered that the defendant remain in ICPC custody pending trial and directed an accelerated hearing of the case.
Despite this ruling, the defence has filed a fresh bail application. The ICPC says it has responded with a counter-affidavit and remains resolute in ensuring diligent prosecution and strict adherence to due process.
